Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of novaelevatemarketing.com and any services purchased from Nova Elevate Marketing (“we,” “us”), a marketing services company headquartered in Houston, Texas. By using the Site or purchasing services, you agree to these Terms.

1. Services & packages

Our service packages, prices, inclusions, and exclusions are published on our homepage. Each engagement includes exactly what is listed for the purchased package; anything beyond listed deliverables is custom work quoted separately in writing. We may decline work that is unlawful, deceptive, or outside our expertise.

2. No guaranteed results

Marketing outcomes depend on many factors outside any provider’s control. We do not guarantee search rankings, traffic volumes, lead counts, appointment counts, or revenue. Testimonials or examples, if any, describe individual experiences and are not promises of your results.

3. Fees, billing & cancellation

• One-time setup fees are due before work begins and are non-refundable once work has begun.
• Monthly retainers are billed in advance and are not pro-rated; service continues through the paid period.
• Service is month-to-month. Either party may cancel with 30 days’ written notice. No cancellation fees.
• Advertising budgets (“ad spend”) are paid by you directly to the advertising platforms and are separate from our fees.
• Usage-based third-party costs (phone numbers, SMS/email volume, AI usage beyond included limits, premium licenses, domain renewals) are billed at cost and disclosed before they apply.

4. Client responsibilities

You agree to provide timely access, accurate business information, and content approvals; to own or license any materials you supply; and to use our deliverables lawfully. Delays in providing materials may extend timelines.

5. Ownership & intellectual property

Upon payment in full for the applicable deliverables: your website, domain, content we create for you, your ad accounts, and your customer data are yours. We retain ownership of our pre-existing tools, processes, and know-how. CRM services run in a sub-account under our platform license; on cancellation we will export your contacts and data to you and, at your option and cost, assist migrating to your own subscription.

6. Third-party platforms

Our services rely on third-party platforms (e.g., WordPress, Hostinger, GoHighLevel, CloseBot, Google, Meta). We do not control and are not responsible for their availability, policies, pricing changes, or acts. Their terms apply to your use of their services.

7. Revisions & support

Each deliverable includes two rounds of revisions unless stated otherwise. Support levels (email/text, response targets) are as published for your package; “unlimited support” means reasonable business-hours use with responses within one business day, covering your marketing system.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising from the services is limited to the fees you paid us in the three (3) months preceding the claim, and neither party is liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited by law.

9. Governing law & venue

These Terms are governed by the laws of the State of Texas. Exclusive venue for disputes is the state or federal courts located in Harris County, Texas.

10. Changes to these Terms

We may update these Terms; the “Last updated” date reflects the current version. Continued use of the Site or services after changes constitutes acceptance.
